2. Subject Matter (The Services)
Pury-Reviews provides a cloud-based software solution (SaaS) that enables companies to manage, collect and analyze online reviews on third-party platforms (e.g. Google, Trustpilot etc.).
The functional scope results from the current service description on pury-reviews.de at the time of contract conclusion.
We reserve the right to update, expand or adapt the software at any time to take into account technical progress or legal requirements.

3. Registration and Account Security
Creating a user account is required to use the services. The User undertakes to keep all information (name, email, payment data) truthful and up-to-date.
The User is solely responsible for maintaining the confidentiality of their access data. Any use of the account under their access data is attributed to the User.
Pury-Reviews reserves the right to temporarily or permanently block accounts in case of justified suspicion of abuse or violation of these GTC.

4. Payment Terms and Fees
The User selects a subscription model (e.g. monthly or yearly) upon conclusion of the contract. Fees are due in advance.
All payments are processed via secure third-party providers (e.g. Stripe). The User authorizes Pury-Reviews to collect the applicable fees via the selected payment method.
Automatic Renewal: Subscriptions renew automatically for the selected term unless they are canceled before the end of the current period.
In case of payment default, Pury-Reviews is entitled to restrict access to the dashboard until payment is received.

5. Intellectual Property
All rights to the software, design, source code, texts and logos of Pury-Reviews rest exclusively with the Provider.
The User is granted a non-exclusive, non-transferable and non-sublicensable right for the duration of the contract to use the software as intended for their own business purposes.
The User is prohibited from decompiling, copying or using parts of the software for their own competitive products.

6. Permissible Use and User Obligations
The User is obliged to comply with applicable laws when obtaining reviews. This applies in particular to:
Competition Law: No purchase of fake reviews.
Data Protection: Ensuring that end customers have consented to receiving invitations (GDPR).
Review Gating: The User undertakes to observe the guidelines of the respective review portals. Deliberate filtering of negative reviews ("Review Gating"), if prohibited by the target platform (e.g. Google), is at the User's own risk.
Pury-Reviews assumes no responsibility for the deletion of reviews by third-party platforms or the blocking of the User's business entries due to policy violations.

7. Limitation of Liability
Pury-Reviews is liable for damages resulting from injury to life, body or health and for damages based on intent or gross negligence.
In case of slight negligence, Pury-Reviews is only liable for the violation of an essential contractual obligation (cardinal obligation), limited to the contract-typical, foreseeable damage.
We do not guarantee 100% availability of the software. Maintenance work or disruptions at third-party providers (hosting, API interfaces to Google etc.) are outside our sphere of influence.

8. Term and Termination
Termination can occur at any time at the end of the agreed term via the dashboard or by email to Info@pury-reviews.de.
The right to extraordinary termination for good cause remains unaffected.
After termination of the contract, access to the account will be blocked. The User is responsible for exporting their data before the end of the contract.

9. Information on the Right of Withdrawal (for Entrepreneurs)
Since our offer is exclusively aimed at entrepreneurs within the meaning of § 14 BGB (B2B), there is no statutory right of withdrawal for consumers. Nevertheless, we may grant voluntary goodwill periods if explicitly stated on the pricing page.
10. Data Protection
Personal data is processed strictly in accordance with the requirements of the GDPR. Since the User processes their customers' data via our platform, the conclusion of a Data Processing Agreement (DPA) is required, which we provide digitally.
11. Final Provisions
The law of the Federal Republic of Germany applies.
The place of jurisdiction for all disputes arising from this contract is the registered office of Pury-Reviews, provided the customer is a merchant.
Should individual provisions be invalid, the validity of the remaining GTC remains unaffected.
